Jammu, Feb 12: In simple words favouritism means the act of unfairly treating one person better than others because you like them better. Favouritism might spur a lack of motivation and have serious impacts on engagement at work, team relationships and your career path. It contributes to poor morale.
For the government servant, promotion is an advancement from lower post, class or service to a higher post, class or service involving higher duties, responsibilities and authority, it also means elevation in the status and increase in the salary for the employee. Mere increase in the salary is not promotion.
In Skill Development Department a particular number of ” Helpers ” who were required to be adjusted against clas iv vacancies as per Govt. Order No. 26-F of 1994, dated 31-01-94 were adjusted on higher post of Junior Assistant, instead. The seniority of the Helpers was not considered and the influential were taken on pick and choose. Whether promotion quota utilised as such, was available or not is issue for discussion. They had developed close affinity with the senior officials/officers of the Establishment Section of the Directorate as they were posted for a pretty long time there. Khan, Badyari and Mohd Fateh were promoted vide order no. DTE 965 of 2007, 447 of 2006 and 749 of 2007 taken directly from S. No. 07, 14 and 30, leaving their seniors unreasonably. Afterwards when Administrative Department took the cognizance of the violations and illegality of the case, following personal and written representations, of the concerned, they put the orders in abeyance, so issued illegally, without the prior approval of the Administrative Department/Finance Department, vide Government Order No. 55-Edu (Tech) of 2013, dated 08-03-13. But this order was not implemented in time by the Directorate as the beneficiaries were posted there as receipt clerk and other one in the section who was there responsible to forward it further and the officers were dodged by not showing the order to them.
The incumbents who were benefitted fraudulently, further got in-situ promotions on the post of Junior Assistant, Vide order no.816 of 2016 dated 19-12-2016 and 247 of 2017 dated 29-03-2017, while playing foul about the facts. The meeting seemed so enchanted and casual in approach that Mohd. Fateh is shown as Helper/Junior Assistant without mention of initial appointment-designation unlike others mentioned in the annexure in the in-situ order. It is ambiguous and doubtful in the eyes of law. Two designations cannot exist simultaneously, for an employee, and a beneficiary cannot be taken ‘either of the two.’ at the luxurious use of money from the State Exchequer. He should be clearly one of the two. Those senior to them as Helpers are still craving for regularisation or those regularised as Orderlies as per government notifications and circulars are so at the cost of losing their seniority to the selectively promoted lot.
The news was carried by the Jammu Jottings on July 12, 2022 and on July 20, 2022 along with order No. 55 Edu. Tech of 2013 and was again highlighted on June 5, 2023. The case was not considered. Now the Helpers so effected come up with the Govt. Order No.720-JK (RD&PR) of 2023, dated 22-12-2023 which is issued to the effect that some ineligible officials at the clerical cader, have been promoted against different categories/posts through DPC in gross violation of recruitment rules, instructions/Circulars of GAD without clearing the mandatory type test (etc).” All such promotions are hereby declared as null and void and such officials are immediately reverted back to their original position from the post illegally held by them for which they are not eligible.”
In Skill Development the matter is double pronged: 1. The beneficiaries taken on pick and choose without falling in seniority, on affinity basis, against norms, the order having put in abeyance by the Adm. Department; 2. Blue eyed promoted to higher post against govt. Order No. 26 F of 94, dated, 31-01-94 without required exams as mandatory in light of recruitment rules for the post and as a consequence of it sanctioned in-situ promotion on illegally held post, vide order No. 818 of 2016, dated, 19-12-16 and 247 of 17, dated, 29-03-17.
“All people have the right to be treated equally.” is a maxim in law. This means that laws, policies and programs should not be discriminatory and also that public authorities should not apply or enforce laws, policies and programs in a discriminatory or arbitrary manner. So, those promoted against well-defined orders, circulars and notifications through whimsical orders (not through DPC) need to be reverted back with a penalty to the officers involved, to clear the system of unscrupulous elements for the sake of justice, as has been done by Rural Development and Panchayat Raj department.
