Skill Development Department shows more misdeeds

Jammu, Jun 24: Taking a holistic view of the issue regarding the regularisation of adhoc contractual and consolidated employees, the Government of Jammu & Kashmir in 2010 enacted a law for the said purpose. The law is known as The Jammu and Kashmir Civil Services (Special Provisions) Act, 2010. Clause 5 of the Act provides for conditions of regularisation of such employees. Clause 11 makes an officer/official liable to reimburse to the Government the salary drawn by a regularised employee if he has forged or fabricated documents in order to give undue advantage to such regularised employee or in any way helped him in securing such documents for claiming regularisation, apart from being liable to disciplinary proceedings.
In Skill Development Department, JK, certain misdeeds committed by the officers/officials, while forwarding the cases to Empowered Committee for scrutiny of documents, have been coming to fore. The information available with The Daily Jammu Jottings is suggestive of the fact that the Government/ Empowered Committee was deceived and cheated in order to help the claimants to gain the post illegally.
Since the matter is of grave concern the verifiable facts are given here-under with humble request to Lt Governor and Chief Secretary to look over as anon as possible.
Vide Order No. 647 of 1994, dated 17-10-94, Director Technical Education (Skill Development Department) temporarily engages one Zahoor Ahmad Beig for conducting of Electrician Trade on consolidated pay of Rs 2500 per month as an academic arrangement till a graded post of Instructor is sanctioned on the strength of the Institute to run trade.
It clearly indicates that he was not appointed against clear vacancy as demanded by Section 5, subsection (i) of the Act, 2010 to be a necessary pre-requisite for being considered for regularisation under this Act. Moreover, Section 3 sub-section (b) says, “The Provisions of the J and K Civil Services Special Provisions Act, 2010 shall not apply to” Academic Arrangements for a fixed term in any govt department.”
While posted at ITI Budgam the DDO forwards his Service Biodata to the higher authorities for scrutiny by the Empowered Committee and mentions the date of initial appointment order as 01-10-1994 instead of 17-10-1994 and shows the claimant as Adhoc employee instead of Academic Arrangement, against writings in initial appointment order. (Under Dispatch No. Nil, Dated Nil). Also, cadre of the subject is changed from Instructor Electrician Trade to Drawing Instructor with effect from 17-10-1994, (Day one of engagement). Both Sub-section (i) and (ii) of Section 5 of the Act 2010, are contravened by the DDO.
Regarding sub-section iii of the section 5, about requisite qualification, it is important to mention here that as per initial appointment order vide order No. 647 of 1994, dated 17-10-94 the subject is shown ‘reportedly a Diploma Holder’. The documentary evidence shows that really he is a Diploma Holder in Electrical Engineering but the Marks Card of the 10th Standard under Roll No. 809083, April-May 1989, shows him Fail in Maths subject and St. Marks in Social Studies. Aggregate marks percentage is 30.62, when 20 marks of Fail subject Maths are included. How he got admission in Polytechnic for Diploma is something hard to digest but it is surely a test of knowledge to the concerned. Third Year (Diploma) Marks Certificate issued under S No 182, Exam Roll No. 5433 shows the candidate passed with Grand Total Marks 3337 out of 5000 in Electrical Engineering.
Director Technical Education (Skill Development Department) under office endorsement No. DTE/101/2482 iv /565, dated 28-05-2018 under subject Regularisation of adhoc, contractual, consolidated employees, vigilance clearance thereof, shows the subject’s date of appointment as 01-10-1994, designation as Drawing Instructor (without mentioning adhoc or academic arrangement) with postings held from 17-10-94 in ITI Pulwama, Ganderbal, Srinagar and Budgam when adhoc or academic arrangements are not transferred from their original place of posting.
Vide Govt. order No. 90 – edu- (Tech) of 2018, dated 24-07-2018 the subject is regularised as Drawing Instructor. The subject joins on the same day as regularised Drawing Instructor (vide joining report under No. Nil, Dated: 24-7-2018, AN), when the same Govt. Order, in a lucid manner, directs the Institutes where the appointees were working to allow them to join formally on the post on which they were regularised after checking/verifying the DOB, PRC, Academic and Technical qualification certificates.
It is in place to mention here that in addition to the above some more have been regularised as Jr. Instructors/Drawing Instructors under jk CS Sp. Prov. Act, 2010 who were not Contractual, Consolidated, or Adhoc as per their initial appointment orders.
