Khour, Feb 27: In a startling revelation, the ongoing inquiry into the illegal construction of a marriage hall in Khour has uncovered atrocious violations of land regulations. Tehsildar Khour, Monika Sharma, JKAS, spearheaded the investigation, leading to a comprehensive 42-page report submitted to DC Jammu, Sachin Kumar Vaishya, IAS, under reference No. NTM/761, dated 12/02/2024.
The inquiry revealed a flagrant disregard for land laws, with the construction undertaken on Khasra No. 1, designated as Gair Mumkin Choi land, despite the ownership documents pertaining to Khasra No. 3. Such an act constitutes a clear breach of regulations, as construction on Gair Mumkin Choi land is strictly prohibited by law.
With the report now in the hands of DC Jammu, Sachin Kumar Vaishya, IAS, the community eagerly anticipates decisive action. Given his reputation for stringent enforcement, speculation abounds regarding the potential measures he may take. Will he order the demolition of the illegal structure, or perhaps repurpose it for government use, given its unlawful nature and location on unauthorized land?
The gravity of the situation is magnified by past reports from Jammu Jottings, which first highlighted the illegal construction on April 28, 2022, under the headline “Illegal Construction of a Marriage Hall in Khour Spotted on Khasra No. 10/1.” Subsequent coverage in the February 25, 2024 edition, titled “Illegal Construction Halted: Tehsildar Monika Sharma Acts Swiftly within 24 Hours,” underscores the authorities’ commitment to swiftly addressing and rectifying unlawful constructions.
It may be recalled that Jammu Jottings had reported on February 25 that, “In a commendable display of swift administrative action, Monika Sharma, JKAS Tehsildar Khour, has initiated prompt measures to curb illegal construction activities within her jurisdiction. The vigilant officer acted promptly after receiving a report highlighting the unauthorized construction of a Banquet Hall in the village of Marchangi, Tehsil Khour.
The illegal construction, undertaken by one Ram Paul, raised concerns as it encroached upon land in Khasra numbers 1 and 7, situated in Marchangi Tehsil Khour. The structure spanned across Khasra number 1, measuring 125’X100′, and Khasra number 7, measuring 100’X20′. Notably, Khasra number 1 is Shamlat Deh, and Khasra number 7 is the proprietary land of Sh. Baj Singh and Sh. Joginder Singh, sons of Sh. Hans Raj.
Upon verification of the revenue records and a spot visit, Tehsildar Monika Sharma issued an immediate directive (Letter No: TK/OQ/2023-24/677, Dated: 23/01/2024) to halt the ongoing construction, citing the illegal possession of Ram Paul on the said land. The possession was deemed unauthorized under Section-133 of the Land Revenue Act.
The Tehsildar directed Naib Tehsildar Khour to conduct a demarcation and verify the revenue records to identify the precise location of the construction. In compliance with these orders, Naib Tehsildar Khour swiftly submitted a detailed report (Letter No: TK/OQ/2023-24/678-80, Dated: 23/01/2024), highlighting the illegal construction’s specific location and the land’s ownership.
The Deputy Commissioner Jammu had asked tehsildar Khour to submit a report on the alleged violation of Land use by the persons mentioned in the compliant to which Tehsildar Khour acted swiftly and submitted the report to DC Jammu within 24 hours citing the violation and action thereof.
In a subsequent communication to the Deputy Commissioner, Jammu, Tehsildar Khour, Monika Sharma, emphasized the need for immediate action. She reported that Ram Paul’s possession on Khasra numbers 1 and 7 was illegal and unauthorized. Despite presenting documents indicating the purchase of land from Khasra number 3, Mr. Ram Paul had no legal claim to the land where the Banquet Hall was being constructed.
The report submitted by Tehsildar Khour led to a restraint order on Ram Paul, preventing any further construction until proper permissions and Change in Land Use (CLU) approvals were obtained from competent authorities. Naib Tehsildar Khour was also directed to ensure the construction’s cessation until the final outcome of the case.”
With the detailed report now open and the saga unfolding, all eyes remain on DC Jammu, Sachin Kumar Vaishya, IAS, to uphold the rule of law and restore integrity to land use regulations in the region.
