Jammu, Aug 10: In a different move, a fresh miscellaneous petition has been moved before the High Court by Rohit Sharma through Senior Advocate Sunil Sethi and Adv Parimoksh Seth seeking call detail records and GPS locations of members of Trap team and the then SSP ACB Rajouri w.e.f 01.11.2022 (date of filing of complaint) to 14.11.2022 (date of registration and execution of impugned FIR) including call detail records and GPS locations of accused petitioner (Rohit Sharma) and complainant for the said period in FIR No. 02/2022 registered in P/S ACB Rajouri.
As per the petition, it has been prayed that the impugned FIR was registered by ACB Rajouri in blatant violation of Government order regarding jurisdiction of Police Station of ACB. Besides, it has been averred that the entire trap proceedings were conducted in a fake, dramatized and highly motivated manner by an officer of rank of DySP and his associated team which is ample clear and evident in CCTV footages, which have already been provided to the High Court by Adv Sunil Sethi in main petition No. 2788/ 2022 and is a part of court record.
Case was listed on 07.08.2023 in JK High Court, Jammu before the Justice Sh. Vinod Chatterjee Koul.
During court proceedings, it was vehemently argued by Adv Sunil Sethi and Adv Parimoksh Seth that a transparent, free and fair investigation is a matter of right of accused (Rohit Sharma) who has been implicated in a False frivolous and highly motivated FIR by Sleuths of ACB Rajouri and the present Misc. petition of seeking Call Detail records and GPS locations of ACB officials and complainant has been moved to unfold the criminal conspiracy and procedural lapses conducted by ACB Sleuths in registration and execution of impugned FIR in collaboration with complainant (who already is facing more than 04 separate Criminal FIRs related to forgery of Revenue records, criminal conspiracy etc)
While hearing the petition, High Court Justice Sh Vinod Chatterjee Koul admitted the petition and issued notices to all concerned. Next date of hearing has been fixed on 19.08.2023.
Pertinent to mention that Government of J&K after noticing certain irregularities in registration of FIR and procedural lapses in trap proceedings had already transferred the impugned FIR no 02/ 2022 from ACB Rajouri to Central Bureau of Investigation, Jammu Branch and reportedly investigation is under way.
While hearing another petition, the High Court has also impleaded CBI as respondent in all associated petitions filed by Rohit Sharma through Sr Adv Sunil Sethi and Adv Parimoksh Seth.
Strangely, It has also come to notice that the officers of Anti corruption Bureau who have been arrayed as main respondents in main petition filed by Mr Rohit Sharma have maintained silence and have failed to file parawise reply till date except SSP ACB Jammu who has simply submitted before the Hon’ble High court that the case has been transferred to Central Bureau of Investigation.
In other words, the averments / parawise submissions made by Mr Rohit Sharma through Sr Adv Sunil Sethi and Adv Parimoksh Seth in main petition ( filed in Dec 2022) has not been replied by the Respondents till date.
