Ratno Devi is struggling for her legal right, cousin snatched her land

Revenue officers have to play honest role!

• Kanshi ram and Garo Devi were legally divorced on 07-01-1962 and the couple was having a 7-momth old daughter Ratano devi at that time, so she is legally entitle for the share of her father.

Jammu, Jun 04: How can person/persons have two fathers on documents? How can person/persons have two different statuses in regard of parentage? How can a person be called as adopted son without legally adoption? How can person/persons have two different parentages on his different documents like school leaving certificate and voter card and ration card? What was the necessity to have two different parentages on the different documents of Madan Lal and Subash Chander? These are very typical questions irritating in the mind of people and these questions must be enquired in depth by the authorities to bring out the reasons behind this fraud.
There are two brothers Madan Lal and Subash Chander actual sons of Chela Ram resident of Flora Harmkund Tehsils Marh, district Jammu are the trouble-shooters who have two different parentages in their different documents like Permanent Resident Certificates (1988), School Leaving Certificates, Ration Card (1982-83), Voter Card. The trouble had started with the divorce of Late Kanshi Ram the elder brother of Chela Ram, who was married to Garo Devi. The marriage of Kanshi Ram and Garo Devi could not last long and on 07-01-1962 they were legally divorced by the court, whereas at the time of divorce the couple was having a daughter of seven months namely Ratno Devi. In the divorce documents it was mentioned that the Ratno Devi would live with her mother till seven years and her father Kanshi Ram would pay monthly expensive for the Ratno Devi.
The problem erupted when the Madan Lal son of Chela Ram had tried to get the share of late Kanshi Ram after the death of Kanshi Ram on 31-10-2021 and forcibly occupied the land of Kanshi Ram, when Ratno Devi legal daughter of Kanshi Ram and Garo Devi had gone to the land for cultivation after the death of her father but Madan Lal and his brother pounced on her and forced her to leave the land.
Ratno Devi, being a legal and biological daughter of Kanshi Ram and Garo Devi, she has the entire right on the land owned by Kanshi Ram but the Madan Lal and his family members are making fraudulent claim over the land measuring 10 kanal approximately. It is pertinent to mention that Ratno Devi has approached the civil court under File No 95/Civil dated 20-09-2002 and on 14-09-2011 the court gave a verdict that Ratno Devi is daughter of Kanshi Ram. Whereas, the concerned Sub Divisional Magistrate vide his order No SDM/M/2022-23/76 dated 17-08-2022 has too declared that Ratno Devi is daughter of Kanshi Ram.
The most intriguing part of the story is that after the divorce Kanshi Ram has not solemnized the second marriage and opted to live alone. But Chela Ram the brother of Kanshi Ram has hatched the conspiracy and attempted to prove it that both of his sons Madan Lal and Subash Chander are the sons of Kanshi Ram. Whereas, the date of birth of Madal Lal is 10-10-1973 as per the school leaving certificate but in the year of 1988 the Chela Ram (under file No 117 dated 12-06-1988) has managed the PRCs for his both sons namely Madan Lal and Subash Chander as the sons of Kanshi Ram, whereas the most important supporting document for getting PRC Ration Card annexed with the file for obtaining the PRCs clearly showed that duo Madan Lal and Subash Chander were nephew of the Kanshi Ram and the then Kanshi Ram was the head of family.
Not only this, even the Kanshi Ram himself mentioned in a Power of Attorney dated 27-08-2009 given to Madan Lal for the purpose to attend the court that ‘Madan Lal son of Chela Ram (adopted son of Kanchi Ram)’ which has deflated the claim of Madal lal that he is son of Kanshi Ram. It has come to know that there is no adoption deed and in the absence of adoption deed there can be no valid adoption.
The president of J&K Development Society Brij Bhushan and a social activist has come across this atrocity being wreaked on the Ratno Devi who is a poor lady and do not have any support from her relatives. Her mother Garo Devo had then solemnized second marriage ad settled her life but the unfortunate Ratmo Devi is struggling for her legitimate right of her father but her uncle Chela Ram and his sons are harassing her on one other pretext. Ratno Devi who is a poor lady and more than 61 years is suffering with each passing and looking towards revenue officials to help her on the merits and facts.
