Assembly secretariat on 20-07-2001 advertised three posts but appoint only 2, defying all rules

CBI enquiry is mandatory to save assembly institute!
- The senior advocate Abhinav Sharma said that no one can reduce or enhance number of posts as mentioned in advertisement notice except it has been mention in the same advertisement notice that number of posts can be reduced or hiked at the appointment, even then they have to give justified reasons.
Q It is an eye opener that how in past the appointments were made in assembly secretariat by the then officers and now the Lt Governor must initiate an inquiry by CBI starting from this case to detect all such cases to sack all such appointees. - It is very pertinent to mention that in the advertisement notice nothing has been mentioned about the reducing or hiking the posts despite that they have violated the laws openly and gave undue benefit to the selected candidates but now the issue has surfaced and the honest LG will take cognizance.

Jammu, Feb 26: How can the then Selection Committee comprising three Deputy Secretaries of assembly secretariat (August 2001) appoint two candidates when the advertisement was made for three posts of ‘Reporters/Jr Scale Stenographer’ by assembly secretariat itself? Why such type of illegal and unconstitutional tactics have been adopted by the then Selection Committee comprising three Deputy Secretaries of assembly secretariat who were entrusted with a job to select the candidates for the three posts of ‘Reporters/Jr Scale Stenographer’? Why the then Selection Committee comprising three Deputy Secretaries of assembly secretariat had played with law of land and selected two candidates when several candidates had applied for the post of ‘Reporters/Jr Scale Stenographer’? These are several harsh questions on the recruitment made in assembly secretariat on 31-08-2001 vide No LA/7594-96/Admn/2001 and the officers of assembly must come out with a reply for such type of malafide appointments.
As per the law the process of recruiting the new employees have certain principles and laws and that should be followed by the officers who are entrusted the job to recruit the applicants. The advertisement made by the concerned department has to play vital role in recruitment besides informing the unemployed youth.
Here in this case, where two ‘Reporters/Jr Scale Stenographers’ have been appointed by the then Selection Committee was against the law of land. The senior advocate of J&K and ex-president of BAR Jammu Abhinav Sharma clearly said that no any recruiting agency or selection committee can recruit less or more that posts advertised except if it has been mentioned in advertisement notice. The senior advocate said, “If the concerned department had category mentioned in the advertisement notice meant for the same posts that number of posts can reduce or swell during recruiting then it is justified otherwise it is illegal, unconstitutional and deemed to be cancelled at any stage.”
He said that the recruitment has certain procedures, laws and principals, and these should be followed. He said that selection committee has no power to select less or more candidates then the advertisement posts if there is no mention about it in the then advertisement notice. He said such cases must be highlighted at every stage so that wrong doings should be rectified.
It is pertinent to mention that the then officers of assembly secretariat had invited the applications from the candidates through advertisement notice vide No LA/Admn/5689/2001 dated 20-07-2001 published in a less circulated Urdu newspaper to give undue benefit some of candidates but in that advertisement notice there had not been mentioned about the decrease or increases of posts.
