Jammu, July 03: The Central Administrative Tribunal (CAT) Jammu has delivered a scathing indictment of the Higher Education Department’s promotion practices, staying the placement list of In-charge Principals and ordering the department to consider eligible candidates who have cleared the mandatory Jammu and Kashmir Public Service Commission (JKPSC) examination. This order exposes a blatant disregard for established rules and raises concerns about favouritism within the department.
The CAT’s intervention came after a group of aggrieved lecturers and professors filed an application (O.A./673/2024) challenging a recent order issued by the Higher Education Department (Govt. Order No. 343-JK-(HE) of 2024 dated 28/06/2024). This order appointed several individuals as In-charge Principals of various colleges, despite their failure to qualify the mandatory JKPSC exam.
Shockingly, 13 eligible candidates who had successfully cleared the JKPSC examination were overlooked for these positions, prompting protests and demands for a fair and transparent selection process. The CAT, in its order dated June 28, 2024, acknowledged the applicants’ grievances and stayed the impugned government order to the extent it relates to the placement of those who had not qualified the PSC exam.
The Tribunal observed, “Prima facie the case is made out… The Department is directed to consider adjusting/posting the applicants as Principals, as per the rules, on available vacant posts as they have qualified the PSC examination.”
