Skill Development Department transcribes bad history

Jammu, Aug 05: During 1990s the Technical Educational Department (Now Skill Development) J&K, taking advantage of the Disturbance in the valley, made engagements/ appointments in the department randomly. The engagements so made are depicting more of nepotism than of meritocracy. All the appointments have been made in contravention of Articles 14 and 16 of the constitution. The persons so engaged in the decade are engaged against the law as they are engaged without a proper selection process. No advertisement notice/notices were issued thereof. Neither the appointees were subjected to any process of selection, nor was the merit list prepared. Thus the engagements were made without following the constitutional mandates of Article 14 and 16 which require transparent and fair selection process. As per Supreme Court’s varied rulings as in one in State of Orissa and Another Vs Mamanta Mohanty and Basudeo Tiwari Vs Sido kanhu University can be cited to reiterate that appointments made without proper selection procedures cannot confer any right to the appointees.
The Directorate of Technical Education vde letter no DTE/201/169/99/2555 DATED 21 -07-99 and no DTE/201/2001/1673 dated 11-10-2001 moots a proposal with some clarifications to the Principal Secretary to the Government, Higher Education Department, j and k Srinagar regarding engagements of candidates in Academic Arrangements under subject: ” Creation of Staff for Regularisation of 47 persons working under Academic Arrangements in various ITIs of J and k State.” The proposal reads that in the year 1991 the department mooted a proposal for creation of staff for 3 ITIs namely Samba, Women ITI Budgam and Rajwara Handwara, created under Border Area Development Program. Besides seven schemes were introduced under Vocational Training Project World Bank Aided Scheme during the Financial year 1993-94. These schemes were included: 1) State Project Implementation Unit; 2) Establishment of related Instructions; 3) Provision of A.V. Aids; 4) Modernization of IT Is; 5) Introduction of Courses for Self Employment; and 6) Introduction of Trades/courses in 4 ITIs
The proposal further says that there was sparing deficiency of staff in the ITIs .Stressing upon the need for instant engagements the proposal reads that in absence of sanctioned/regular staff for these ITIs the department engaged persons on Academic Arrangements from time to time. Out of 68 persons who were engaged under Academic Arrangements some candidates have left the job and the number is now reduced to 47 only. The proposal says that the details of persons working on Academic Arrangements are given in the annexure ‘ B ‘ to this letter indicating date of engagement of these hands with their designation, technical qualification, assignment of work as per their qualification and experience.
The department is proposing creation of 30 posts of Junior Instructors in the pay scale 4000-6000 for adjustment/ regularisation of all the 3 categories v.z. Drawing Instructors, Junior Instructors, Language/Social Study Instructors.
Further it is said that as regards 17 persons engaged as Drivers/Assistants and Attendants as per NCVT norms the pay scale of 2550-3200 is proposed.
In the concluding para of the letter it is said that now in order to regularise/adjust permanently the services of 48 officials (in the subject it is 47 officials) engaged on Academic Arrangements in various ITIs of J and K state it is requested that necessary sanction for creation of posts as indicated above may kindly be got issued and orders for their regularisation/adjustment conveyed to this Directorate. Attached with the proposal as discussed above is the list of staff engaged on Academic Arrangements in ITIs (Date of engagement and order no, as said above in the proposal is skipped for the reasons best known to them).
At serial no 1 of annexure to proposal is Zahoor Ahmad Beigh S/O Ali Mohammad Beig, qualification 3 Years Diploma in Electrical Engineering with One year’s Diploma in Computer and work assigned is Electrician Instructor. Placed in ITI Srinagar. It is in place to mention here that Vide Directorate Order No DTE / 647 of 1994, dated 17-10-94, he was engaged as Electrician Instructor and posted in ITI Pulwama, with qualification Diploma in Electrical Engineering (1 year Diploma is not mentioned there in the appointment letter). How he is transferred from Pulwama to Srinagar as Academic Arrangement is a question. Then Vide list of candidates working on consolidated pay in adhoc appointments against the Direct Quota posts having executed agreements in pursuance of the policy related to the adhoc appointments vide 794- GAD of 2004, dated 22-05-2004, he is shown as Drawing Instructor – a superior post with regard to having better promotion chances than a Jr. Instructor.
As confirmed by a source from the Directorate Technical Education, he is the son of one Ali Mohammad Beig, who was Jr. Assistant to Head Assistant (Accounts Section) Directorate, posted over decades there and at the point of time his beneficiary son got engaged. It is patent example that falsifies the claim in the proposal that everything has been done under NCVT norms.
