Jammu, Jul 15: The Additional Session Judge-08 West/THC/Delhi has rejected the bail application of accused Sudershan Singh Wazir and said that at the prevailing stage no ground for bail is made out.
“The accused is an influential man and there cannot be any second opinion regarding the same. He has been an MLC and member of Gurudwara Prabandhak Committee in Jammu and Kashmir”, the court said, adding “if he is released on bail, he may tamper with the evidence and influence the witnesses as well”.The court further said, “the most important aspect, while considering the regular bail application of accused under Section 439 CrPC, are the gravity and seriousness of the offence as well as severity of the punishment”, adding “the offence under Section 302 IPC is the most serious and grave offence in the IPC. In case of conviction, accused shall be liable to suffer at least life imprisonment. Hence, this consideration goes against the accused”.The Judge further said, “I am of the considered opinion that at this stage no ground for bail is made out. Accordingly, the bail application under Section 439 CrPC of accused is dismissed.”
