Why Tehsildar Marh Ram Pal Sharma is not taking the orders of Deputy Commissioner Jammu and Sub Divisional Magistrate Marh seriously? Why Tehsildar Marh Ram Pal Sharma is ignoring the orders of Deputy Commissioner Jammu? Why Tehsildar Marh Ram Pal Sharma is snubbing the orders of Sub Divisional magistrate Marh? Why Tehsildar Marh Ram Pal Sharma is not implementing the orders of Sub Divisional Magistrate Marh regarding the partition of land among legal shareholders? Which file is lying in Udhampur as it is mandatory for partition of land in Marh? Why Tehsildar Marh Ram Pal Sharma is waiting for a file lying in Udhampur? Is there in Udhampur any head office regarding to partition of land in Marh Teshsil? Is Tehsildar Ram Pal Sharma running his own kingdom in Tehsil Marh as per his whims and fancies? These are the questions which should be answered by the officers of Revenue department especially Deputy Commissioner Jammu that why Tehsildar Marh is not taking seriously the orders of Deputy Commissioner Jammu and Sun Divisional Magistrate, besides he is playing with law of land.
On the application of one Jyoti Devi, the Sub Divisional Magistrate Marh vide his letter No SDM/M/2019-20/318 dated 20-06-2019 has given a judgement to carry the partition of proprietary land falls under Khasra No 287, 288, 272, 179, 281, 269, 206, 198, 203, 252, 201, 203, 200 & 206 situated at village Shehzadpur Maratha and Khasra No 651, 901, 1015, 940, 481, 686, 766, 941, 1098, 13, 197, 286, 300, 747 & 173 situated at village Chauhana Chak Tehsil Marh district Jammu. In his order to Tehsildar Marh, he wrote as “With reference to the subject cited above, it is intimated that one court case titled Jyoti Devi V/S Rattan Lal have been instituted in thei court and on the perusal of appended filed record it has been found that the said case is of partition of land among the shareholders. In this connection, you are directed to constitute a team of officers/officials for verification of the matter and carrying partition of the land in question falling under above said Khasra No’s as per Land revenue Act. The said assignment may be carried in time bound manner so that the interest of shareholder did not get spoiled due to overstay of our department proceedings. The action taken report in the matter to be submitted to this office.” The order is signed by Tariq Hussian Naik KAS Sub Divisional Magistrate Marh. The order clearly directs the concerned tehsildar not to spoil the case due to overstay of our department proceedings. It clearly shows that there is no need of more proceedings at tehsildar or any other level.
Not only this the aggrieved party approached the Deputy Commissioner Jammu with her grievances and consequently the office of Deputy Commissioner Jammu immediately shot a letter vide its letter No DCJ/GGC/2021-22/324-25 dated 31-05-2021 to SDM Marh with a direction to implement the order of SDM Marh dated 20-06-2019 that too within a week’s time positively. But it is the intriguing part of the story that for Tehsildar Marh Ram Pal Sharma, the orders of Deputy Commissioner Jammu has no relevant as the man is running its own kingdom in Tehsil Marh, where the Deputy Commissioner Jammu has no power or authority. Now the matter is that why Tehsidar Marh Ram Pal Sharma is undermining the orders of Deputy Commissioner Jammu and what hidden authority he has to defy the orders of DC Jammu, this should be clarified and Tehsildar Marh Ram Pal Sharma must reveal it. The DC Jammu must go tough on tehsildar Marh Ram Pal Sharma openly defying the orders of DC Jammu otherwise other tehsildar would also follow his suit.
It is pertinent to mention that only Tehsildar is authorized to do the partition and no other revenue officer is authorized to do partition this has been told by Naib tehsildar Marh. Knowingly, the Tehsildar Marh is killing the time and making worthless excuse like a file is in Udhampur and when he will get the file then he will go for partition.
