It is totally illegal building!

*The JMC has canceled the Building Permission for residential purpose of Nirmal Sachhar vide its letter No 727/BS/10 dated 29-12-2010.
*How Nirmal Sachhar build such a huge commercial building without permission from BOCA?
*How has she changed the land use from residential to commercial, when her land allotment has been declared illegal by JDA vide letter No CTP/JDA/BPC/768-72 dated 18-12-2010.
*Nirmal Sachhar has mocked on the law of land and cocked a snook at the entire government machinery, which is more dangerous than any terrorists’ attack.

Imparting of education is the best profession in this world but the process of imparting education must be legal and cleaned so that there should be no lacuna in the process.
But here in the case of ACM Public School Janipur Jammu everything is illegal and contrary to the law of land as the owner of the institute has played many fouls and started the school not to impart the education but to mint the money as this business has been flourished for last couple of years as one of the easy making money. The owner Nirmal Sachar daughter of Behari Lal has got permission to construct a residential building that too ground floor with one storied but she constructed three storied as the chairman of the ACM Public School replied in its reply against an RTI filed to know the status.
The chairman of ACM Public School and owner Nirmal Sachhar both have lied on several occasion to cheat the system. It is very long story that Nrimal Sachhar has got the land in her name by illegal means, whereas BOCA approved the building plans and she got the building permission was issued by Jammu Municipal Corporation vide No: 1/BS/2004 dated 01-04-2004 for the construction of residential house consisting of ground and 1st floor.
She failed to start the construction work and so she again applied to the chairman BOCA for the revalidated of the building plans and the plan was revalidated vide No 840/BS/2010 dated 15-09-2010.
But she not stopped here, she started the construction work and started violation too on the first day of construction work, besides she indulged in encroachment of the state land. The JMC received a complaint against her for violation and encroachment, the then Chief Enforcement Officer and Jojnt Commissioner (A) recommended for keeping the said building permission in abeyance. Whereas the then Commissioner, JMC ordered that permission granted vide No 840/BS/2010 dated 15-09-2010 shall be withdrawn immediately and was withdrawn vide No 485-488/BS/2010 dated 18-09-2010.
Nirmal Sachhar again approached the Commissioner JMC and stated that she has removed the construction/walls which were raised on spot in violation of the approved building plan. Nirmal also assured that she would not violate any terms and condition laid by the JMC and not encroach the land. After this the Commissioner JMC ordered to restore the permission which was withdrawn vide No 485-488/BS/10 dated 18-09-2010 and restored permission vide JMC order No 628/BS/2010 dated 29-11-2010.
But the big fraud has come on surface when the Jammu Development Authority vide its letter No CTP/JDA/BPC/768-72 dated 18-12-10 informed the JMC that the allotment made in favour of Nirmal Sachhar daughter of Sh Behari Lal at Janipur near Devak Community Hall jammu by JDA falls in the list of illegal allotments. Till the time the matter is not resolved. This was stated in a reply of RTI of JDA vide No AO/JDA/RTI/137/65 dated 29/102010.
The intriguing part of the story that how has BOCA issued the Building Permission with the NOC from JDA and the matter is very fishy and the then officials are fully involved in all these illegal acts, which must be investigated properly to ascertain the truth as who was behind all this illegal and foul play, which is against to the law of land.
