Jammu, May 09: Once again the Deputy Commissioner Jammu Avny Lavasa has given an exemplary decision by cancelling the illegal mutation of land measuring 24 kanals 13 marlas under Khasra No 356 of village Paloura tehsil Jammu North as it was not sustainable and bad in the eyes of law.
As per the order of the Court of deputy Commissioner Jammu one advocate has filed a complaint and the court has treated the said complaint as an appeal and issued notice to the complainant and non-complainant over the issue. The Court of deputy Commissioner Jammu has sought detailed report from the Tehsildar Jammu North and it was established that land under Khasra No 356 village Paloura as per Jamabandi of year 1959-60 is recorded as State Land and in cultivation of Hazara Singh adopted son of Matawa Rajput, Gair Maroosi. Whereas, land measuring 08 kanal under Khasra No 356 was transferred to Kali Singh son of Balbir Singh Manhas by government Order of LB-6, S-432 vide mutation No 3421 and land measuring 24 kanals & 13 marlas was attested in favour of Rattan Singh adopted son of Hazara Singh Manhas rajput by virtue of Govt order No of LB-6 & S-432 vide mutation No 2004/1 which was then inherited by the sons of Rattan Singh namely Harnam Singh, Ghulab Singh, Sohan Singh, Omkar Singh in equal shares.
While examining the record from 1957 to onward, besides being relied on the record and report furnished by the Tehsildar concerned that the mutation No 2004/1 jeem prima facie seems to be bad in the eyes of law as mutation number itself is questionable and is not in continuity as it ought to have been a continuous number hence not sustainable and liable to set aside.
The said court has ordered as ‘…the mutation No 2004/1 dated 06-06-2008 for the land measuring 24 kanals 13 marlas of village Paloura (very costly land) Tehsil Jammu North is hereby set aside with the direction to Tehsildar to restore original position of record prior to attestation of the mutation impugned.
It is pertinent to mention that Avni Lavasa is known for her bold decisions and she has cancelled the mutation already as SDM. She is very dynamic, energetic, justice-minded, pro-people and bold person, who can take bold decision for the welfare of the society.
