Doctors must abide by law!

Jammu, Oct 29: How can the doctors working Head of Departments of Medical Education working in Government Medical College Hospitals do private practice despite the ban? Why are these arrogant doctors working Head of Departments of Medical Education working in Government Medical College Hospitals violating the government orders regarding banning of their private practice? Why are the doctors working in particular town or area and doing private practice in different town or area despite the restraining orders? Who will bridle these violator doctors who are violating the law of land like criminals? These are some hitting points of the doctors who are hell bent to fleece money from the patient that too openly violating the ors laid for them.
The Heads of Departments or all Government Medical Colleges violating various Government orders of “Banning Private Practice” and many other Doctors of Health and faculty of GMC also openly violating Government t orders of “Restraining Practice” at different towns/areas away from their place of posting but the administration has opted criminal silence over the issue.
Government Order No. 43/HME of 2013 dated 17.01.2013 by virtue where of private practice of Heads of the Departments (HODs) working in Government Medical Colleges and Associated Hospitals besides Dental Colleges of the State has been banned but the they cock a snook and openly violating the banning orders.
Many HODs went to High court against this order but High court Dismissed their plea saying “There being no merit in the petition, the same is accordingly dismissed alongwith connected CMA(s).”
Even after this ban All HODs brazenly violating Government and High court order but the government has become mute spectator and till date there is no action against them.
Not only this some non clinical doctors working in GMCs in general in GMC Jammu in particular are practicing even they are getting Non Practicing Allowance. Even they are frequently visiting Reasi and Katra for private practice. There is a Pharmacology professor in GMC Jammu moves to Katra to do Private practice as a physician even though he is non clinic subject doctor and may be drawing Non Practicing Allowance from government exchequer. One HOD working in SMGS Jammu is doing private practice at her own nursing home, which is against the law of land.
A HOD of ENT practice in the heart of Jammu city, HOD paediatric Practice at Gangyal, HOD Ortho practice at Bakshi Nagar, the HOD gastro practices at Canal Road, and HOD Ortho Doda practice at Doda city. One HOD GMC Rajori moves to Akhnoor for practice, so likewise almost maximum HOD of GMCs violating government orders. Even the HODs have lost their case in Law of Court against the ban of private practices. Whereas, all the Doctors of all Faculty of GMCs should also not do Private practice during their OPD/Emergency and Operation theatre days as per Government SRO which allows practice in J&K but no one follows these rules.
Many Doctor from Health and Medical also violating brazenly another Government order 612- JK(HME) of 2022 dated 12-8-2022 issued just few day back, which clearly restrains all government Doctors from practicing to different towns or area away from their “place of posting” as they may be required at the time of emergency but doctors violating this order too and health administration is mum about their conduct.
For example one doctor working at GMC as Consultant Medicine but visits Samba town for doing private practice. A Neurologist and Medical Officer at Super Specialization hospital also move to Samba town for practice. One Neurologist work at Medical College Kathua but practice daily at Shastri Nagar Jammu, which may causes difficulty to patients in case of any emergency arises at Kathua. A Consultant Ortho GMC Jammu visits Udhampur for private practice. A gynaecologist posted at Billawar but doing private practice at Baribrahmana town of Jammu. One Child specialist posted at Reasi but practice in a private hospital in the way of Mira sahib Jammu. A Child specialist posted at Hira Nagar practice at Talab Tillo Jammu. An Ortho consultant posted at Sarwal Hospital moves to Akhnoor for private Practice, another child specialist posted at Katra but practice at Jammu. A Skin Specialist posted at GMC Rajouri as Registrar doing practice in different areas of Rajori and Poonch. Dr Rajneesh surgeon specialist at Sarwal hospital goes to RS Pura for private practice. One Ortho consultant posted at Batote moves to Udhampur for private practice. One Registrar Skin also moves to Rajori town for private practice. A Consultant Surgeon Posted at Kot Bhalwal hospital but moves daily to Akhnoor for practice. A Ortho specialist posted at Akhnoor but he does practice in Janipur Jammu. A physician posted at RS Pura but does his private practice at Nowshera. Almost every Radiologist moves in different towns of J&K for doing USG etc. Eye specialists are also moving in different towns for eye camp and practice, whereas Aesthetics posted at different places of state can be found in nursing homes of Jammu during evening, away from their place of posting.
Many of the doctors who are Registrars are actually “Senior Resident Doctors” which cannot do practice as per rule but doing practice and violating Government rules.
It has been learnt that these doctors write prescription on plain papers which don’t carry their names and other details, and see patients very early in the morning to avoid any trouble.
Sources said many doctors are also running their MRI centres, CT scan and labs while recommending their patients to get their test done there and charge them heavily.
“Some doctors see patients at their private clinics and do their surgeries and tests at GMCH on the priority basis while the common people get suffer,” said a medico adding that they had indirectly brought the matter into the notice of higher authorities but to no avail.
