Jammu, Sept 09: So far as the occurrence of incidents is taken from this communication it is understood that Rabia Rasool has never been a Workshop Attendant on the substantive post which is necessary for being promoted to the post of Junior Grade Instructor, Stenography from Departmental Promotion Quota. SRO 145 Dated 10-04-2002, Non- Gazetted Recruitment Rules ITI wing says: For promotion quota for Junior Grade Instructor Stenography, 25% should be taken by selection from the class vii category A viz. Workshop Attendant and the candidate must possess minimum speed of 65 words per minute in shorthand and 35 words per minute in typing. Here the department is responsible and answerable before the law. Breach of law in any form is never acceptable under the law of the land. It is the question of a permanent job. Those deserving might be selling grams on the hand carts.
However, in the said official communication it is further written that Rabia Rasool is substantively a Junior Grade Instructor (Stenography) borne of the cadre strength of ITIs of Kashmir Division and temporarily placed in the Directorate as Stenographer (Higher post without Recruitment Rules in her favour) in May 2003 (Prof. Masooda Yaseen ) and the arrangement is reversible. Our question to the present Establishment Section of the Directorate is why at all she was temporarily placed in the Directorate as Stenographer (PA) in May 2003. On whose mercy the trainees were left in the ITI whereas per Recruitment Rules Rabia Rasool had to work as Junior Grade Instructor Stenography for which the pay was drawn from the treasury of the state. What circumstances compelled the department to make double drawl for the same post while engaging another soul for imparting training to the trainees in the ITI where she was supposed to be posted. Why did the department abet her to block the promotion chance for those who were working against the substantive post of Junior Stenographer class ll category B viz Pran Nath and Gh Nabi Dar, which is their only feed cadre for promotion to higher post. If the arrangement as per the above said official communication is reversible why has it not been reversed till date since 2013. If, as per the written statement she is a substantive Junior Grade Instructor, Stenography, why does not her name figure in the Final Seniority List of Vocational Instructors issued by the Joint Directorate on 02-06- 2022. Further if it is admitted that she has no right against the Ministerial Cadre Post of Sr. Scale Stenographer (PA) as per the rules in vogue, why didn’t the litigation Section of Directorate fight the case tooth and nail when Rabia Rasool had earlier moved the High Court of J&K, Jammu through the medium of SWP No.114 /2005 and when the High Court of J&K Jammu disposed of the case on 23-09-2005 on being it devoid of any merit in light of Recruitment Rules.
Why the Directorate and its Litigation Section, headed by SO Khursheed Ahmad Diwani (retired) and then Head Assistant, Masood Ahmad Sheikh (now SO at Directorate), worked as silent spectators and as such abetted her, when Rabia Rasool moved the High Court of J&K at Srinagar with unclean hands on the same subject through SWP No.1142 /2008 CMP No. 2018/2008, when the case was already disposed of by the Jammu High Court. If in the above matter, the High Court of J&K at Srinagar in the interim order Dated: 05-08-2008 directed as under: “Meanwhile status quo as on the day and date be maintained till next date of hearing.” Why was not an urgent memo filled before the High Court for hearing the case immediately? Why is a subject allowed to submit the same plea to the High Court at Srinagar when it is already disposed of by High Court at Jammu? Isn’t it very bad in the eyes of law? Why was not a legal action sought against the culprit when it is admitted in another communication to Javid Ahmad Kawoosa, then Additional Advocate General, J&K High Court, Srinagar vide letter No. DTE/101/43/181-82 Dated : 23-03-2011 by Director, (Sourabh Bhagat, IAS) Technical Education, with a copy to Deputy Director, Technical Education to follow up the case in the High Court, J&K Srinagar, that her case on the same subject has already been disposed of by High Court at Jammu. It is fishy at Directorate. Under what norms she has been given 5200 as grade pay by the DPC, when it is 3rd insitu promotion. Role of Accounts Section at the Directorate as a pay assessing unit is to be questioned. All those representations by the Vocational Instructors for 3rd insitu have been rejected who ever have got a single promotion and as such do not qualify for the 3rd insitu. Taking a lenient view means to play foul.
It is a very grievous case of favouritism, misuse of official position, concealment/distortion of facts, violation of norms, incur recurring loss to state- Exchequer, direct war against rights of those employees who were legally due for promotion to the post of Sr. Stenographer, a deliberate attempt to sabotage the constitutionally guaranteed hierarchy in the official system, devalue of merit, abet corruption and un necessary stubbornness in doing justice to the stakeholders. All this dented the honour of an organisation.
In addition to all this there have been verifiable allegations of corrupt practices against the incumbent, Rabia Rasool, as were covered in the Daily Jammu Jottings as news item on January 03, 2022 under heading “Directorate of Skill Development is haven for blue eyed employees”
How influential she was in the Directorate can be gauged by a fact when under SDI she erected a sign board for “Hannan Institute of Technology” and showed its function in papers only and under Account No. CD 23 of JK Bank Moving Secretariat drew illegally 14 lack rupees as a camouflaged beneficiary, when actual account holder is someone else. Will Directorate mind to identify the “trainees” admitted in the said Institute? Will the concerned training section of the Directorate care to make public the names of the trainees provided a job after completion of the training in “Hannan Institute of Technology? The training section should have necessarily available the list of the trainees shown admitted in the Institute. Why was the employee of the same office allowed to establish an Institute in her residential house? What course of action the Directorate took since the news item was covered by the print media?
In another news item titled ” Officials at SD Department make it a win-win situation “, wherein she is alleged that she succeeded in engaging her maid at home on IDF in ITI Pattan, JK, and this news item is supported by unrefuteable evidence of a document that the appointee was with her at Directorate of SDD at Jammu (winter secretariat) unauthorised and illegally for months when a temporary based employee can’t be shifted to another office normally.
The Director did not break the ice over the 6 months now. So, Govt. is requested that it is a multi-pronged case of corruption so it should be enquired and all those officials and officers should be fixed responsibility at, and should be brought to book at an earliest who are found involved in this case.
The incumbent is sitting idle in the Directorate for decades now. The respected Director is working from Jammu Office and so called PA is ‘working’ at Srinagar office. In the matter of one representation from Junior Stenographer, working in the Directorate on a genuine post, for fixing his seniority as per rules which has been trespassed upon by Rabia Rasool, the file is moving at a snail’s pace for last two months in the Directorate and finally is at the table of Director. Who will unravel the mystery and end the confusion? Is it boon or bane?
