Skill Development Department misinterprets rules, violate recruitment rules
It is egregious, scandalous!
- The Lt Governor must spare some valuable his time to understand the mockery being cooked in Skill Development Department and to put the things right.
- The inner administration of Skill Development Department is totally upset and damaging the department but there is no reform in this case.

Jammu, Jun 15: How can Skill Development Department promote an employee in violation to J&K Civil Service Rules? How can Skill Development Department promote juniors and ignore seniors, creating havoc in the department? Why the Deputy Director of Skill Development Department is in hurry to promote an employee without any DPC and what was his intention? WHY DPC and Empowered Committee both are opting contrary rules for same purpose? The people in general and the employees and students of Skill Development Department are anxious to know that what is going inside the department and what type of mockery is being engineered.
Vide letter No DSD/101/DPC-2022/C/179-80 dated 01-06-2022, issued by Deputy Director, Skill Development, two employees Reyaz Ahmad Shah, Vocational Instructor, ITI Anantnag and Nazir Ahmad Molvi, Vocational Instructor, ITI, Jammu, have been shown as prospective candidates to be placed to the next higher posts on promotion.
SRO 145 of 2002, dated, 10-04-2002 defines the method of recruitment for the post of Junior Instructor, now Vocational Instructor, figuring at class iv, category A as 75% by Direct Recruitment having Matric + ITI (in relevant trade) and 25% from the category of Workshop Attendants, having Matric + ITI with 3 years experience in relevant trade after qualifying Practical Test.
Reyaz Ahmad Shah, existing on serial number 06 in above quoted letter has been appointed in violation of Recruitment Rules – SRO145 of 2002 for the post of Junior Instructor, figuring at class iv category A. The qualification for the post is shown as Matric + ITI in relevant trade. The incumbent does not possess this qualification. The department has considered his higher qualification. Rules are rules and can’t be interpreted by whim or wish. It is substantiated by the fact taken from the department itself. Under the J and K Civil Services (Special Provisions) Act 2010 an Empowered Committee was constituted to recommend the cases of Contractual, Consolidated and adhoc appointees for regularisation. The committee did not recommend Rukhsana Ahmad (ITI Srinagar) for the post of Vocational Instructor in Electronic Mechanic, appointed by Director Technical Education on the basis of 3 years diploma. The Empowered Committee declare the incumbent ineligible for want of requisite qualification i.e Matric + ITI in the relevant trade as per the recruitment rules, SRO 145 of 2002. Why didn’t the department submit objections to the Empowered Committee in the case of Rukhsana Ahad at that time within the stipulated period. It is clear that they couldn’t make their plea on the basis of Recruitment Rules. So, they accepted the decision, though against their submitted proposal.
Another official, Nazir Ahmad Molvi, existing on serial number 09 in the above quoted letter, proposed for the post of Technical Assistant is not falling in promotion quota as Workshop Attendant. He is not Matric + ITI in the trade he is appointed as vocational Instructor as indicated a requisite qualification in SRO 145 of 2002. He is qualified in Plumber and Instrument Mechanic in ITI. He is appointed as Instructor, Draftsman Civil by Director Technical Education vide order no. 251 of 2013 dated 25-03-2013. Then for whom are these rules. Why didn’t DPC take cognizance of these errors? He is included on the basis of 3 years Diploma in Draftsman Civil. It is not within the ambit of SRO 145 of 2002. Why two different interpretations of the same rule by two different bodies? Empowered Committee declares ineligible a candidate on the basis of having no ITI in the relevant trade and DPC declares eligible a candidate ignoring the trades he is qualified in and required for further promotion as per SRO 145. This is irony.
Moreover Mr Molvi’s promotion as Workshop Attendant is not confirmed by any DPC when “promoted” by Deputy Director Jammu vide order no. 18 of 2006 dated 02-06-2006. When a Deputy Director can promote to a higher post then what is role of DPC in the matter of promotions. When considered on the basis of Plumber/Instrument Mechanic for Workshop Attendant Nazir Ahmad Molvi is far junior to others. Then he exists on serial number 61. When considered on the basis of 3 years diploma, he falls on serial number 35. It relegates work culture. When a Junior is picked from among others ignoring rules and his equals and seniors are made to work under him as subordinates, they feel psychologically reluctant to work. They feel humiliated. That is why for promotion seniority is one important factor. Instructors of 80’s are still waiting for promotion and Instructor of 2006 is about to become an officer. Somewhere there is “snag”. Hope Director Skill Development Department will look into the matter objectively as per the rules governing at present.
